Please read them carefully. They do not affect your statutory rights.
This site is owned and operated by DC Health & Wellbeing (‘DC Health & Wellbeing’, ‘we’ or ‘us’ or ‘our’). If you have any questions or comments with regard to these terms and conditions please contact us by email.

THE CONTRACT BETWEEN US
Any contract for purchases made through the website will be with DC Health & Wellbeing. DC Health & Wellbeing must receive payment of the whole of the price for the goods that you order (unless a deposit has explicitly been paid) before your order can be accepted, and the contract formed.
Once payment has been received DC Health & Wellbeing will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. DC Health & Wellbeing’ acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
DC Health & Wellbeing is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail to inform you of a cancellation of those items from your order.
GENERAL TERMS
These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.
Additional terms and conditions may apply for prize competitions, online bidding, pre–release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.
These terms and conditions only cover the DC Health & Wellbeing website. Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
DC HEALTH & WELLBEING PROMOTIONS 2023
DC Health & Wellbeing runs promotions for their customers and reserves the right to cancel or amend these promotions if misused or necessary. All 100% discounts can only be used once per customer per category and must not be duplicated. DC Health & Wellbeing reserves the right to cancel any order where they deem a discount code to have been inappropriately used without the approval of DC Health & Wellbeing.
Percentage-off discount codes cannot be used on: Gifts Cards or Sale Items and any others stated on site.
Multi-buy discounts, such as 2-for-1 promotions will not apply to the following exclusions: Gift Cards, Sale Items and any others stated on site.
Promotions are available, subject to availability and while stocks last, through: the DC Health & Wellbeing website.
You can only apply one discount per order.
GIFT WITH PURCHASE

A limit of one Complimentary Product per transaction applies to this Promotion. For the avoidance of doubt, if an Eligible Participant makes multiple Qualifying Purchases in a single transaction, they would not be entitled to any more than one Complimentary Product.

There is no cash alternative to the Complimentary Product. The Complimentary Product is not exchangeable for cash or for any other DC Health & Wellbeing product or service.

If you believe you made a Qualifying Purchase but you did not receive a Complimentary Product, please contact DC Health & Wellbeing using the details in these Terms.

The Complimentary Product may be exchanged on its own for another size (if applicable) but otherwise may not be returned or exchanged on its own, in which case it will be exchanged for a replacement DC Health & Wellbeing product of the same type, subject to availability. If none of the same type of DC Health & Wellbeing product remains in stock, then DC Health & Wellbeing reserves the right in its sole discretion to exchange the Complimentary Product for another type of DC Health & Wellbeing product of a similar value.

If any paid product forming part of the Qualifying Purchase is returned for a refund or exchanged, so that the total amount spent on products included in the Promotion falls below the required spend described then the purchase will cease to be a Qualifying Purchase and the Gift must be returned in an undamaged and saleable condition

If the Complimentary Product is not returned (in breach of these Terms), or if the Complimentary Product has been damaged, DC Health & Wellbeing reserves the right to deduct from any refund due to you (or charge the payment method you used for the original purchase) a sum equal to the then current price at which the Complimentary Product is available for purchase. If you are returning a product forming part of the Qualifying Purchase that you bought through the DC Health & Wellbeing Website, you may choose not to return the Complimentary Product in which case we shall deduct its price or charge you for its price as stated in this Term, and the amount of the deduction or charge will be notified to you in advance.

Returns of the Complimentary Product on its own (regardless of condition) will not result in a refund or payment to you of any sort.

Nothing in these Terms shall affect any participant's legal rights including all rights in respect of refunds, replacements and repairs for products which are faulty, not fit for purpose or not as described.

This Promotion is subject to stock availability and, whilst reasonable efforts have been made to ensure sufficient stocks are available to meet likely demand, DC Health & Wellbeing may suspend or end the Promotion early without notice if, in the opinion of DC Health & Wellbeing, there is not sufficient stock to continue operating the Promotion.

DC Health & Wellbeing reserves the right to cancel the Promotion or amend the Terms without notice in the event there is any actual or anticipated breach of any applicable law or any other event outside DC Health & Wellbeing' reasonable control.

DC Health & Wellbeing reserve the right to not award a Complimentary Product or disqualify a participant if there are reasonable grounds to believe that any person is not eligible or for any other lawful reason, including unruly behaviour or failure to comply with these Terms.

Any other use or reproduction of the material or content is strictly prohibited.

While we will use reasonable endeavours to verify the accuracy of any information we place on the DC Health & Wellbeing website, we make no warranties, whether express or implied in relation to its accuracy.

PAYMENT DETAILS
DC Health & Wellbeing accepts payment by Visa, MasterCard, Amex, ChinaUnionPay, Jcb, Diners, CartesBancaires, Discover, Electron, Maestro, Paypal. All product prices and delivery charges are shown in UK pounds sterling inclusive of VAT at the applicable rate. Your payment card company will perform any currency conversion.
DC Health & Wellbeing takes responsibility to ensure that your payment is secure. We do this via secure payment pages and by secure Adyen or Stripe servers.
AVAILABILITY OF GOODS YOU ORDER
If DC Health & Wellbeing has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by DC Health & Wellbeing from your credit card will be re-credited to your account and DC Health & Wellbeing will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. DC Health & Wellbeing will not be obliged to offer any additional compensation for disappointment suffered.
Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update.
HEALTH, WELLBEING, FITNESS & PERSONAL TRAINING
FREE CONSULTATIONS
All Health & Wellbeing Programmes, Fitness Programmes and Personal Training are eligible for one free consultation. This will be for 15 - 30 minutes depending on the customers needs. This consultation is free and, therefore, not refundable.
PAR'Q (PHYSICAL ACTIVITY READINESS QUESTIONNAIRE) & WAIVER
All clients will be assessed using a PAR'Q (Physical Activity Readiness Questionnaire) and asked to sign a waiver to protect both the client and DC Health & Wellbeing before starting any of our 6 Week Health & Wellbeing programme, Fitness Programmes and Personal Training Sessions.
The PAR'Q has to be completed to make sure that clients are physically able to participate in any physical activity available to them throughout any of the services mentioned above involving physical activity.
During the PAR'Q clients will be asked questions about their health and lifestyle and all information will be kept private and confidential between the client and DC Health & Wellbeing. Please see our Privacy Policy for more information.
If the client is found to be unsuitable for physical activity during our PAR'Q, it will be advised by DC Health & Wellbeing that the client does not participate in any physical activity available to them throughout any of the services mentioned above.
The client will still be able to participate in the Health and Wellbeing Programme, but not the optional physical activity.
If the client decides that they do not want to take liability for themselves and carry on with their subscription, the client has 48 hours after the PAR'Q has been completed to cancel, only if the PAR'Q deems them unsuitable for physical activity. The full price which they have paid to that date will be returned to them and their subscription will be cancelled. After the 48 hour period the client can no longer cancel their subscription even if deemed unsuitable. Please note: If the client has been deemed suitable for the physical activity in any of the DC Health & Wellbeing serves they are not eligible for cancellation. Please see our Returns Policy for more information.
However, if the client still wants to participate in the physical activity provided by DC Health & Wellbeing in any of the services mentioned above, they can do so but will be asked to sign a waiver which will hold them accountable for any liability. DC Health & Wellbeing will take no liability for any injuries or damage caused to the client, any person or animal around them or to their surroundings caused after this waiver has been signed.
In the event of a death caused during or because of the client participating in physical activity after the waiver has been signed, DC Health & Wellbeing will not be held accountable.
MICROSOFT TEAMS MEETINGS AND SESSIONS
Microsoft Teams is used for all of our video calling, this includes the free consultation (if the video call option has been selected), the Health & Wellbeing programme and the Personal Training.
During Microsoft Teams meetings and sessions it is imperative to comply with our rules whilst participating. This allows us to create a safe, accepting and supportive environment with out judgement where all clients can feel able to participate comfortably throughout every video call. These rules have to be agreed to before starting the first video call with DC Health & Wellbeing. These rules are listed below:

Do not talk over each other or the instructor during video calls.

Please contact us via text or email if you are unable to attend and the instructor will make alternate arrangements with you.

Respect each others views.

It is strictly forbidden to record all video calls made by DC Health & Wellbeing for the protection of all clients and instructors unless informed otherwise.

Keep your camera on your device on during physical activity so that the instructor can see that you are exercising correctly.

Make sure you have enough space to exercise around you safely so that you do not injure yourself.

Respect confidentiality by ensuring that no other person is in the room during participating in video calls.

Anything that is confidential shared within a group setting must not be discussed out of the group setting.

Please ensure that you are in a quiet area during all video calls. If you have to take an urgent phone call please switch off the microphone so that you do not disturb the group setting.

Remain in the meeting session if the call ends suddenly due to connection issues and the instructor will sign back in.

Please familiarise yourself with the Microsoft Teams software, including, how to switch the camera on and switch on and off the microphone. If you need any help with this please ask your instructor they will be happy to help.
FITNESS PROGRAMMES
Our fitness programmes are all online and can be accessed via your members area. They are copyright of DC Health & Wellbeing and it is illegal and a criminal offence to share, copy, use or sell any content from them.
When participating in the fitness programme, please be aware that is is your responsibility to make sure you have enough space to exercise around you safely so that you do not injure yourself, other people and animals around you or create damage to your surroundings.
MEAL PLANS
For a meal plan to be complied and completed the client must fill in an online form. This form will give DC Health & Wellbeing the information they need regarding the clients health issues, lifestyle, dietary requirements or allergies. This information is overed by our Privacy Policy.
The client will also have to inform DC Health & Wellbeing on the reason they are opting to incorporate a meal plan into their lives and what they hope to achieve from following it. All of this client information will be assessed and a meal plan will be compiled for the them.
The meal plan will be emailed to the client as a protected PDF file. The client is allowed to print this file but it is copyright of DC Health & Wellbeing and it is illegal and a criminal offence to share, copy or sell any content from it.
PERSONAL TRAINING
It is illegal and a criminal offence to record, share, copy, use or sell any of our Personal Training Sessions content for the protection of our instructors and DC Health & Wellbeing.
When participating in the personal training sessions, please be aware that is is your responsibility to make sure you have enough space to exercise around you safely so that you do not injure yourself, other people and animals around you or create damage to your surroundings.
DOWNLOADABLE CONTENT
All downloadable content is subject to copyright, it is illegal and a criminal offence to share, copy or sell this content. Although it can be used for personal use and printed out for your convenience.

HEALTH & WELLBEING ENROLEMENT POLICY
These terms and conditions (hereinafter referred to as "Terms") govern your participation in DC Health & Wellbeing's Packages and Plans (hereinafter referred to as the "Course") conducted by DC Health & Wellbeing (hereinafter referred to as the "Company"). By enrolling in the Course, you agree to abide by these Terms entirely.
Course Overview: The Course is designed to provide participants with comprehensive information and resources related to health and wellbeing. The content includes but is not limited to fitness routines, nutritional guidance, mental health strategies, and lifestyle management tips.
Enrolment: To enrol in the Course, participants must complete the registration process and submit the required payment. Upon successful enrolment, participants will receive access to the Course materials and resources.
Course Duration: The Course duration will be specified upon enrolment. Participants are expected to complete the Course within the designated timeframe unless otherwise arranged with the Company.
Course Content: All Course materials, including but not limited to videos, documents, and presentations, are the intellectual property of the Company and are provided solely for the purpose of personal education and development. Participants are prohibited from reproducing, distributing, or sharing Course materials without prior written consent from the Company.
Participant Responsibilities: Participants are responsible for actively engaging with the Course content and completing all assigned activities and assessments in a timely manner. Participants are encouraged to seek clarification from instructors or Course administrators if they require additional assistance.
PAR-Q Form: Before engaging in any physical activity recommended in the Course, participants are required to complete a Physical Activity Readiness Questionnaire (PAR-Q). The PAR-Q form assesses the participant's readiness for physical activity and helps identify any potential health risks. Participants must truthfully and accurately complete the PAR-Q form and disclose any relevant medical conditions or concerns.
Medical Clearance: Participants who answer "yes" to any of the questions on the PAR-Q form are advised to seek medical clearance from a qualified healthcare professional before commencing any physical activity. The Company strongly recommends consulting with a healthcare provider to ensure the participant's safety and wellbeing.
Microsoft Teams: Course sessions, including live sessions, will be conducted on Microsoft Teams. Participants are responsible for ensuring they have access to a compatible device with internet connectivity to participate in Course sessions. The Company is not responsible for any technical issues or interruptions experienced by participants during Course sessions.
Confidentiality: Participants are expected to maintain the confidentiality of Course materials, discussions and personal information shared by other participants or instructors.
Payment and Refunds: Payment for the Course is due upon enrolment and is non-refundable. In exceptional circumstances, such as medical emergencies or extenuating circumstances, the Company may consider requests for refunds or deferrals on a case-by-case basis.
Termination of Enrolment: The Company reserves the right to terminate a participant's enrolment in the Course at its discretion, without refund, if the participant engages in disruptive behaviour, violates these Terms, or fails to comply with Course requirements.
Limitation of Liability: The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the Course, including but not limited to personal injury, loss of data, loss of revenue, or loss of profit.
Amendments: The Company reserves the right to amend or modify these Terms at any time without prior notice. Any changes to these Terms will be communicated to participants via email or through the Course platform.
CANCELLATION
Once your order has been placed, you are not able to cancel or make any changes to shop orders. Please refer to our Returns Policy for details on returning your order. DC Health & Wellbeing reserves the right to cancel an order if any terms or conditions have been broken this includes giveaways and discount promotions.
Our Health and Wellbeing Packages, Fitness Programmes, Meal Plans or Personal Training Sessions are not applicable for cancellation unless a PAR'Q (Physical Activity Readiness Questionnaire) has been taken and the client has been deemed unsuitable for physical activity. Please refer back to section PAR'Q (PHYSICAL ACTIVITY READINESS QUESTIONNAIRE) & WAIVER above in these Terms & Conditions for more information. Although, if any of your personal information needs to be altered please let us know and we would be happy to alter this for you.
If you are unable to attend a teams meeting or phone appointment regarding any of our services please contact us so that alternate arrangements can be made so that you do not miss out. Your subscription will not be cancelled.
If any of our terms or conditions are broken in relation to Health and Wellbeing Packages, Fitness Programmes, Meal Plans or Personal Training Sessions, DC Health & Wellbeing reserves the right to cancel your subscription with immediate effect and no refund will be made.
EXTENT OF LIABILITY
Any worries regarding components should be investigated immediately and the product should not be used or participated in until safety is confirmed by a qualified DC Health & Wellbeing agent. In the instance of a product failing under normal warranty conditions, DC Health & Wellbeing will endeavour to compensate you for the failed parts.
SAFETY INVOLVING ACTIVITIES CARED OUT WITH/DURING PURCHASED FITNESS EQUIPMENT, TEAMS MEETINGS, FITNESS PROGRAMMES, MEAL PREPERATION AND PERSONAL TRAINING SESSIONS
Safety is key in any activity carried out by our clients at home and we make all of our clients aware of this in advance via advice, rules, regulations and a waiver put into place before any participation is undertaken by our clients.
DC Health & Wellbeing is not responsible for any harm, injury or death caused to yourself, any third parties or your surroundings at the time of incident when using or participating in any of the products or services of DC Health & Wellbeing.
CHANGES TO THIS AGREEMENT
DC Health & Wellbeing reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
WARRANTY
All DC Health & Wellbeing shop products are covered under a one year worldwide warranty. This does not include wear and tear, such as scratches and user damage. Our Health, Wellbeing and Fitness services are not covered by our warranty.
